Terms and Conditions of Sale

These Terms and Conditions of Sale govern purchases of custom LED neon signs, illuminated displays, printed acrylic signs, backlit signage, stands, mounting systems, accessories and related services supplied by Neon Luxe.

Definitions

Neon Luxe, we, us and our refer to the business operating under the Neon Luxe trademarked brand. Customer, you and your refer to the individual or organization visiting the website, using the customizer, requesting a quotation, approving a proof or purchasing a product or service. Custom product means a product created, printed, cut, assembled, adapted or configured for a particular customer.

Acceptance of the Agreement

You accept the applicable Neon Luxe policies and order terms when you place an order, accept a quotation, pay a deposit or full balance, approve a design, instruct Neon Luxe to proceed, or accept delivery. The order agreement may include the final quotation, invoice, approved design proof, checkout summary, written change orders and these policies.
If a signed agreement or expressly accepted commercial quotation conflicts with these website policies, the specifically agreed written term will govern that project to the extent of the conflict. Terms printed automatically on a customer purchase order do not override Neon Luxe terms unless Neon Luxe expressly accepts them in writing.

Authority and Eligibility

You must have the legal capacity to enter into a binding agreement. If you order for a company, agency, venue, event, brand or another person, you confirm that you are authorized to approve the design, submit the content, accept the terms and create payment obligations for that party.

Nature of Custom Products

Most Neon Luxe products are made specifically for the customer and may have little or no resale value after production begins. A product is custom-made when it includes customer-selected wording, artwork, dimensions, colours, printed material, backing, mounting, waterproofing, stands, structural features or other personalized specifications.

Order Process

A typical order may include the following stages:

  • The customer submits wording, artwork, dimensions, preferences or a customizer design.
  • Neon Luxe prepares a preliminary price, quotation, mockup or online configuration.
  • The customer confirms specifications, delivery information and any required deadline.
  • The required deposit or full payment is received and cleared.
  • A final production proof is issued where the order requires separate proofing.
  • The customer provides written approval or approves the customizer configuration at checkout.
  • Neon Luxe begins production, testing and quality review.
  • The completed order is shipped, delivered or released for pickup.

Some simple online orders may proceed directly from the checkout summary into production without a separate proof. The website or order confirmation should clearly identify when this applies.

Final Specifications

Only specifications shown in the final approved proof, accepted quotation, invoice or checkout summary form part of the final order. Preliminary concepts, inspiration images, verbal discussions and earlier mockups are not controlling unless included in the final written specifications.

Specifications may include wording, spelling, dimensions, font, colour, backing, printed elements, cord position, mounting holes, power supply, dimmer, remote control, weather rating, number of pieces, stand design, accessories, quantity, delivery method and installation scope.

Product Descriptions and Images

Website photographs, social media content, mockups and videos may show products in different sizes, lighting conditions, environments or configurations. Furniture, walls, decorative items, installation services and accessories shown in an image are not included unless expressly listed in the order.

Handcrafted Variations

Neon Luxe products involve acrylic cutting, LED placement, wiring, printing, assembly and manual finishing. Reasonable manufacturing variations may occur in exact dimensions, acrylic edge finish, colour temperature, LED position, wire routing, mounting-hole placement, connection points and appearance from different viewing angles. A reasonable variation is not a defect where the product substantially matches the approved design and remains suitable for its intended use.

Colours, Brightness and Screens

Digital displays cannot reproduce illuminated products exactly. Screen calibration, brightness, camera processing, ambient light and background colour may affect how a colour appears. Colour descriptions such as warm white, cold white, lemon yellow, orange, ice blue, turquoise, hot pink and neon green describe general colour categories and are not guarantees of an exact Pantone, HEX, RGB or CMYK value.
Customers requiring close brand-colour matching must notify Neon Luxe before approval. LED neon and printed elements may not reproduce an exact digital or printed brand colour under every lighting condition.

Order Acceptance and Refusal

Submitting payment does not require Neon Luxe to manufacture an unsafe, illegal, technically impractical or clearly mispriced configuration. Before production begins, Neon Luxe may decline an order if the design cannot be produced safely, materials are unavailable, required information is missing, the content appears unlawful or infringing, or an obvious technical or pricing error occurred.
If Neon Luxe declines a fully paid order before production begins, the amount paid for the declined product will be refunded, subject to any separately disclosed and completed non-refundable design service and applicable law.

Production Times

Standard production for most LED neon signs is approximately 8-9 business days after cleared payment, final specifications and required approval. Weekends, statutory holidays, shipping time and periods awaiting customer responses are not included.
Complex, oversized, multi-piece, printed, waterproof, structural, traditional glass neon or commercial projects may require additional time. Production timelines are estimates unless Neon Luxe expressly confirms a guaranteed date in writing.

Rush Service

Rush production may be available for an additional fee and is subject to capacity, design complexity and material availability. A rush fee prioritizes production; it does not guarantee the performance of a shipping carrier unless a separately guaranteed carrier service is purchased and confirmed.

Event and Installation Deadlines

Customers must disclose any firm event, launch, opening or installation date before ordering. A requested date is not guaranteed unless Neon Luxe confirms it in writing. Customer delays in approval, payment, artwork, measurements or site information may move the schedule.

Taxes, Duties and Additional Costs

Prices are normally stated before applicable sales tax unless otherwise shown. The customer is responsible for applicable taxes and any clearly disclosed shipping, customs, import, brokerage, permit, electrical, equipment-rental, site-access, professional-installation or wall-repair costs not included in the order.

Force Majeure

Neon Luxe is not responsible for delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disaster, fire, flood, power interruption, labour disruption, carrier failure, government restriction, public emergency, material shortage or supply-chain interruption. Neon Luxe will make reasonable efforts to communicate material delays and complete the affected order when reasonably possible.

Limitation of Liability

To the maximum extent permitted by law, Neon Luxe will not be liable for indirect, incidental, special, punitive or consequential losses, including lost profits, lost event revenue, business interruption, reputational loss or the cost of replacing surrounding property. Where liability can lawfully be limited, total liability relating to a product will not exceed the amount paid for that product. This limitation does not apply where prohibited by law.

Governing Law and Severability

These terms are governed by the laws of Ontario and the applicable federal laws of Canada. Disputes are subject to Ontario courts except where applicable law provides otherwise. If a provision is found invalid or unenforceable, the remaining provisions continue in effect.

Policy Updates

Neon Luxe may update website policies as its operations, technology or legal obligations change. The version accepted when an order is placed will ordinarily govern that order unless a later change is required by law or agreed in writing.
